Abstract: The study collects the results of the research conducted in 2023 in collaboration with IFEL Campania. It analyzes the regulatory and administrative context of spa tourism, a peculiar tourism sector with a complex model, subject to a plurality of disciplines that contribute to configuring its regime. The historical evolutionary profiles of the notion of health tourism are examined and identified, also through a comparative investigation with other Italian regions and EU countries, the main profiles of interest of the elements that make up the notion of spa tourism (medical tourism, wellness tourism) and the critical issues that characterize the current discipline, for which possible corrective interventions are suggested from time to time. Finally, a regionally oriented administrative path is proposed which adequately considers the need for sharing the discipline with other national and supranational levels of government and favors public intervention initiatives aimed at building a "territorial" competitive advantage in favor of the economy. regional, in which the free competition between the various companies can subsequently be developed.

Bruno Mercurio, University of Naples L'Orientale

Bruno Mercurio is a researcher in administrative law at the University of Naples L'Orientale where he teaches "Digital law for public administrations". He is a teacher in masters and specialization courses at various universities and member of scientific committees editorials of class A scientific journals. He is the author of numerous publications on law administrative, in particular in matters of participation, urban planning, environment and services public.

Marco Auriemma, lawyer

Marco Auriemma is a lawyer and deals mainly with administrative law and in particular with public services, urban planning and the environment. In 2023, he won the IFEL Campania scholarship for the research published in this book.
