Abstract: The intensification of migratory flows is at the origin of the formation of multicultural societies, so called because characterized by the presence of "new minorities", consisting of people uprooted from the original settlement and bearers of family models inspired by principles found in the legal systems of countries of origin or based on customary or religious norms; principles that often appear very distant from those of the countries of immigration. It is therefore necessary to settle the conflicts between the different legal cultures that come into contact, taking into account the nature and plurality of interests involved and having regard to the way in which these interests take shape in the context of family relations.

Giuseppe Cataldi, University of Naples "L'Orientale"

Giuseppe Cataldi is Full Professor of International Law and Director of the Department of Humanities and Social Sciences at the University of Naples "L'Orientale", as well as coordinator of the European Union Jean Monnet Network "MAPS" (Migration and Asylum Policy Systems. Weaknesses, Shortcomings and Reform Proposals) and President of the Association internationale du droit de la mer. He is a consultant to national and international institutions and has practiced before numerous international courts. He is the author of several publications on public international law and European Union law, in particular on the law of the sea, human rights, migrants' rights and the relationship between international and domestic law.

 

Roberta Montinaro, University of Naples "L'Orientale"

Roberta Montinaro is Associate Professor of Private Law at the University of Naples "L'Orientale" and coordinator of the Jean Monnet DiCit Module (Digital Citizenship in the European Union). She is affiliated with Academies and Research Centers, as well as member of the editorial board of scientific journals. She is the author of books and essays on trust law, family law, civil liability and consumer law.
