Abstract: The starting point for the study meeting dedicated to the new perspectives of criminal control on drugs, more and beyond the bill that took its name, as the first signatory, from the Minister of Foreign Affairs of the time, as for the other study activities – seminars, trial simulations, visits to penal institutions, publication of scientific works – comes from the daily confrontation with the students on my part and the other collaborators at the Chair of Criminal Law of the Faculty of Law of Cassino, entrusted to me since the formation of the Faculty in 1997. In our case, the occasion for the Conference, of which the proceedings follow, arose from the intellectual curiosity of Sarah Grieco who, after a brilliant degree in economics at LUISS, having already worked as a tax expert for some time, felt the need to perfect her legal studies, committing herself, in the final research prodromal to the thesis, to deal with a difficult and dangerous issue because, if one is not satisfied with evaluating only the technical aspects of domestic and international discipline, it still requires a choice of field.

Author Biographies

Francesco Saverio Fortuna

After graduating in law from the University of Rome "La Sapienza" in February 1965, with honours, Francesco Saverio Fortuna passed the competition for judicial auditor in December 1967. In the years 1968-1971 he took on the functions of judge in the Magistrate's Court of Monza and in that of Lucca. In 1972 he was called by the Minister for Justice in charge, Prof. Guido Gonnella, to the Ministry of Justice. From 1975 to 1978 he was attached to the secretariat of the undersecretary, Prof. Renato Dell'Andro, professor of criminal law at the University of Bari and, later, constitutional judge. In 1977 he passed the competition for ordinary assistant at the Chair of Institutions of Criminal Law and Procedure held by Prof. Aldo Moro in the Faculty of Political Science of the University of Rome. In the years 1979-1980 he was appointed director of the Central Legal Library and director of the Official Gazette of the Republic by the minister pro tempore Tommaso Morlino. As director of the most important library of legal and economic topics in Rome, he organized the presentation of monographic works by professors Sergio Cotta at the Ministry; Vincenzo Vigoriti, Giovanni Maria Flick. In 1980 he exercised the option, resigning from the roles of the ordinary judiciary. In 1984 he passed the judgment of suitability for associate professor. During the long period of collaboration with the Roman Chair, he held seminars, organized visits to penal institutions accompanying students, followed about 250 degree theses, discussed with Prof. Moro. From 1974 to 1984 he was appointed professor of criminal law at the Academy of the Guardia di Finanza with sixty hours of lectures and two exam sessions.

Sarah Grieco

Sarah Grieco has built a solid and multidisciplinary career, embracing both the legal and academic fields. After graduating from high school with honors at the “Giosuè Carducci” High School-Gymnasium in Cassino, he completed the fifth year of piano at the “Licinio Refice” Conservatory in Frosinone. He then obtained a degree in Economics with a focus on business law at the “LUISS Guido Carli” University of Rome, graduating with honours and presenting a thesis on the tax harmonization of corporations in the European Union. His second degree, also with honours, was in Law at the University of Cassino, with a thesis on the profiles of domestic and comparative law of drugs and criminal control. After an internship at the University of Amsterdam and specialization courses, including one at DIREKTA - National Institute of Higher Legal and Economic Education, Sarah became a licensed lawyer in 2007. He is also a privacy mediator and consultant, having attended various courses on the General Data Protection Regulation (GDPR). His professional career began with an internship at American Express and continued with collaborations in law and tax firms in Rome and Venafro. Since 2005, Sarah has been a partner at the Cifalitti Law Firm in Cassino, where she specializes in both civil and criminal medical liability. He also held the role of acting commissioner for the Lazio Region. Since 2018, Sarah has been a DPO and privacy consultant for companies and public bodies, and a trainer on GDPR. In parallel with her legal activity, Sarah is an adjunct professor at the University of Cassino and Southern Lazio, where she teaches courses on the procedural protections of drug addicts and the criminal control of drugs. She has also collaborated as a subject expert for the chairs of Criminal Law and Criminal Procedure at the same university and has been a PhD student since 2018 in the field of criminal procedure and criminal enforcement. Sarah Grieco is the author of numerous publications on criminal law and addiction issues. Among his best-known works, there are “Drugs and penal control between prohibition and decriminalization”, “The abusive exercise of a profession”, and various articles published in “Dirittifondamentali.it”. He also contributed to the drafting of the White Paper on Drugs. His extra-work activity is equally significant. Sarah coordinates the Desk for the Rights of Prisoners project at the San Domenico Prison in Cassino and is involved in the Right to Study in Prison project for the University of Cassino and Southern Lazio. She is the delegate of the Rector of the university in the CNUPP – National Conference of Rectors’ Delegates for University Penitentiary Poles and a member of the editorial board of the scientific journal “Democracy and social rights”. Sarah is also a member of the Board of Directors of the association “La Società della Ragione” and of the Drugs Forum, as well as being part of the working group for the bill on amendments to the Consolidated Law on the decriminalization of drug consumption and alternative measures to detention. She has organized and participated as a speaker in numerous conferences and seminars, including events on drug prohibition and decriminalization, mafia-type associations, and the new criminal frontiers of addiction. He has contributed significantly to the public discussion on crucial issues such as the reform of the penitentiary system, the immutability of insane offenders and addictions. Sarah also had an active political role, serving as a city councillor in Cassino from 2016 to 2018 and as a member of the regional secretariat of the Lazio PD. His dedication to criminal justice and human rights is evident in every aspect of his career and activities.
